This policy explains what personal data the SoftExclusive website (the “site”, “we”) collects, for what purpose, and how we handle it. By sending a request through the form on the site you confirm that you have read this policy and give your consent to the processing of your data — the consent is recorded by checking the corresponding box in the form.
The only place on the site where personal data is collected is the contact form. You provide voluntarily:
The site does not require registration and does not collect personal data automatically in the background (the anonymized visit statistics are described in section 4).
Providing the data is voluntary and is not a statutory or contractual requirement. However, without a name and an email address we will not be able to process your request and reply to you.
We use the data you provide solely in order to:
The legal basis for the processing is your consent, given when you submit the form, together with steps taken at your request before a possible start of cooperation (an arrangement may also be concluded in correspondence) (Article 11 of the Law of Ukraine “On Personal Data Protection”; Articles 6(1)(a) and 6(1)(b) of the GDPR for visitors from the European Economic Area).
We do not use your contact details for newsletters or marketing emails without your consent and do not pass them on to third parties for advertising. Should a need ever arise to process the data for another purpose, we will update this policy and, where required, ask for separate consent.
Data from the form is transmitted over a secure connection (HTTPS) and goes directly to the SoftExclusive team. Delivery of the request relies on third-party cloud and messaging services, which act as technical intermediaries and do not use the contents of requests for their own purposes. The data is kept in our business correspondence for as long as work on your request continues and further cooperation remains possible. We review older requests periodically and delete those that are no longer relevant. You can ask us to delete your data at any time — we will do so within 30 days.
The servers of these services may be located outside Ukraine and the European Economic Area, so sending a request involves a cross-border transfer of data solely for the purposes described above. These services apply their own data protection measures, set out in their privacy policies.
We do not sell your personal data and do not pass it on to third parties for their own purposes — apart from the technical intermediaries described above and cases expressly provided for by law.
To protect the data we use an encrypted connection, restrict access to requests to the people working on your project, and take reasonable technical and organizational security measures — including strong passwords and, where possible, two-factor authentication. That said, no method of transmitting or storing data can guarantee absolute security.
We do not make automated decisions that have legal effects on you, and we do not carry out profiling.
At present the site does not use cookies. To prevent duplicate form submissions, a technical marker is stored in your browser's storage (localStorage) for 30 minutes: a random identifier and the time until which the restriction applies. It contains no personal data, is not sent to the server, is not used for tracking and is deleted automatically.
The site uses the GoatCounter service to count visits. According to the service's own statement, it uses no cookies, builds no visitor profiles and does not track visitors across sites. The statistics we see record only anonymized data — the page viewed, the country, the browser and device type, and the referring source (referrer). They do not allow you to be identified personally.
The site is intended for adults — business representatives. We do not knowingly collect data from persons under 16. If you believe that a child has sent us their data, write to the address in the “Contact” section and we will delete it.
Under the Law of Ukraine “On Personal Data Protection” and, for visitors from the European Economic Area, the GDPR, you have the right to:
To exercise any of these rights, simply write to us at the email address below. We will reply within 30 days.
If you believe your rights have been infringed, you may lodge a complaint with the Ukrainian Parliament Commissioner for Human Rights (for residents of Ukraine) or with the data protection supervisory authority of your country (for residents of the European Economic Area).
We may update this policy from time to time. The current version is always available on this page; the date it was last updated is shown at the top.
